By placing an order with S&K Label Company, Inc., you agree to the following terms:
1. The S & K Satisfaction Guarantee
S & K Label stands behind the quality of its products and services. If you are not 100% satisfied with your purchase from us, simply contact Customer Service by phone at 800-334-2980 within 30 days from the date you receive it (or the date it was scheduled to arrive), and we will reprint part or all of your order. In some cases, we may refund the full price of the product(s) in question, excluding shipping, postage and processing costs.
S & K Label is committed to customer satisfaction, and we do everything possible to ensure proper die-cutting, accurate color reproduction, and excellent printing quality. However, certain circumstances are beyond our control and are not covered by this guarantee. Please note that we cannot be responsible for:
Spelling, punctuation, or grammatical errors made by the customer.
Inferior quality or low-resolution of supplied images.
Design errors or color selection errors introduced by the customer in the artwork file creation process.
Errors in user-selected options such as product type, size, finishing options, or quantity.
Incorrect file dimensions, image orientation, or file submission in accordance with
S&K Label specifications.
Damage to the products arising after delivery to the customer.
Duplicate orders by the customer.
Incorrect file layout for off-roll direction, die cutting or other custom services.
Incorrect shipping address, undeliverable packages/3rd delivery attempts, or other errors created
by the customer.
This guarantee is also subject to a few other terms and conditions:
The full refund guarantee does not apply to ship claims. We will reprint orders damaged or lost by the shipping carrier.
We reserve the right to have you return the original order, at our cost, before reprinting or refunding your order.
Maximum refund per order or customer is $2500. The only remedy for problems with orders over $2500 is reprinting of the order to correct product defects.
Color match, die-cutting, and registration tolerances are guaranteed to be within industry standards for pleasing color and tolerances published within our website.
This guarantee is limited to reprint of the original order quantity and specifications or refund of the purchase price of the order. We are not responsible for any damages or claims incurred by you or your business caused by receiving printed materials that are defective or incomplete or which you receive later than the estimated delivery date.
Please preview your designs carefully and correct any issues prior to placing and approving your order.
2. Payment Terms
All orders must be prepaid. We accept Visa, MasterCard, American Express, Discover. If you would like to pay by a regular check, your order will not print until the check has been deposited into our bank account. This may cause a significant delay in your order. Under no circumstances will S&K Label Company, Inc. provide COD terms on an order. Credit terms may be applied by customers with whom we have a long-standing relationship, and are reviewed on a case by case basis.
3. Quotations/Estimates
Written estimates are good for 30 days. An estimate not accepted within 30 days may be changed.
4. Accuracy of Specifications
Quotations are based on the accuracy of the specifications provided. S & K Label Company, Inc. can requote a job at the time of submission if the art does not conform to the information on which the original estimate was based. Orders placed with S & K Label Company, Inc. are to the client's knowledge correct, and there are no conditions or agreements relating to the order which are not written or accompanying said order.
5. Orders
S & K Label Company, Inc. reserves the right to use its sole discretion in refusing to print anything it deems improper or known to be illegal. S & K Label Company, Inc. is not liable for any damages resulting from unwitting violation of copyright laws or illegal use of trade names or slogans. The client guarantees the legal title of all matter submitted to S & K Label Company, Inc. for printing and/or publication.
6. Cancellations
A request to cancel should be done by phone to prevent the job from moving forward in the production process. Canceled orders require compensation for incurred costs and related obligations at the time of cancellation. Due to our manufacturing procedures, you may only cancel an order without incurring additional fees prior to the approval of the artwork. All requests for cancellations AFTER a PDF proof, Press proof, or the approval of the artwork are subject to the forfeit of the order deposit. No refunds will be given after orders have entered the production process. No refunds will be given for any artwork services that were performed before cancellation of the job or any special materials purchased for the order.
7. Purchase of Goods and Services
S & K Label Company, Inc. is not an independent contractor and does not perform contract services. Therefore, by placing an order with S & K Label Company, Inc., you are agreeing to purchase goods and/or services. Under no circumstances will S & K Label Company, Inc. perform contract services or make available it's employer identification number for use with a 1099 form.
8. Turnarounds
Turnaround time for a print job begins once the PDF or Press-proof has been approved by you and any remaining payments have been processed. If your job is approved by 10 A.M. Central Standard Time, turnaround time begins that business day.
For example, a job with a seven-day turnaround that you approve by 10:00 am Monday will be shipped out to you on the following Monday afternoon. Please note: that if we do not have all necessary order specifications to print your job, your job status will be put "On Hold" and your turnaround time will be reset.
Allow additional business days for delivery based on the shipping method you selected. Business days are Monday through Friday. Holidays, Saturdays and Sundays do not count when calculating turnaround. Our turnaround times are an estimate and are not to be confused with a guarantee. We assume no responsibility for delays caused by delivery carriers or any damages resulting from the failure to receive a job on time. Your order may arrive late due to unforeseen delays in delivery service, the breakdown of equipment, illness, etc.
9. Electronic PDF Proofs
In order to ensure the accuracy of a label design, S & K Label Company, Inc. supplies an electronic PDF proof for each job. Due to the variation in monitor colors and adjustments, PDF proofs may not provide an accurate color representation of the final printed work. It is recommended that a Press-proof be purchased for all color-critical work.
10. Press-proofs
Press-proofs are suggested for all color-critical work.
11. Proof Approvals
All proofs, whether Electronic PDF proofs or Press proofs, must be approved in writing. Until S & K Label Company, Inc. receives a proof approval or request for revision, no additional work will be performed. S & K Label Company, Inc. will not be responsible for undetected production errors if:
Proofs are waived by the client
The work is printed per the client's written OK
Requests for changes are communicated verbally
All requests for changes of any kind must be made in writing to avoid mistakes.
Turnaround estimates begin after the proof is approved and arrives at S & K Label Company, Inc with written OK.
12. Alterations/Corrections
Client alterations must be specified in writing and must include all corrections or changes from the original specifications. Such work will be charged at our current rates or in accordance with purchased service packages.
13. Color Accuracy
S & K Label will reproduce color from a submitted Pantone color number as closely as possible, but may not be able to exactly match color and density because of limitations in the printing process, as well as neighboring image ink requirements. The accuracy of each color reproduction is guaranteed to be within 90% of the final approved Press-proof or submitted Pantone number, or S & K Label Company, Inc. will reprint the job at no charge to the customer. Please note that S & K Label Company, Inc. cannot guarantee color reproduction for your print-ready files if you did not request a Press-proof or supply a Pantone number.
All Digital Full-Color labels will be printed with the standard 4 color process printing method. Due to the differences between spot color and 4 color process printing, and their respective color gamuts, the printing of Pantone colors may result in unexpected color shifts. Press-proofs are suggested for all color-critical work.
14. Customer Supplied Proofs/Color samples
Inkjet and laser prints are known to look substantially different than production printing. We offer quick turnaround and low prices by printing to a "pleasing color" standard, using standard ink densities. There
is no guarantee that your finished piece will match your printed sample. This is due to the varying results from different output devices including inkjet printers, continuous tone proofing devices, and film-based proofs.
15. Liability
S & K Label Company, Inc.'s liability shall be limited to the stated selling price to the customer of any defective goods, and shall in no event include special, consequential, incidental, indirect or similar damages, including without limitation, lost profits. S & K Label Company, Inc. warrants that every product manufactured by it meets the industry standard for such product and is free of any material defect in workmanship. IT IS EXPRESSLY AGREED THAT THIS WARRANTY IS IN LIEU OF ALL WARRANTIES OF FITNESS FOR PARTICULAR USE AND MERCHANTABILITY. S & K Label Company, Inc. makes no other warranty and no actions or words of S & K Label Company, Inc. or its officers, employees or agents shall constitute a warranty.
16. Indemnification
The customer represents that it has the legal right to produce all printed materials ordered from S & K Label Company, Inc. In the event that a charge, claim or demand or arbitration, action or proceeding (collectively, a "Claim") is made or commenced against S & K Label Company, Inc. based upon, relating to
or arising from the alleged wrongful acts of the customers, or alleging that the printing performed or product produced by S & K Label Company, Inc. ordered by the customer: (a.) infringes any copyright, patent or other proprietary rights of any person; or (b.) contains matter that is libelous, slanderous, defamatory, scandalous or obscene, the customer shall indemnify and hold S & K Label Company, Inc. harmless from and against any loss, damages, cost and expense arising from or related to the Claim including without limitation; (1.) defending S & K Label Company, Inc. against any such Claim (2.) paying any judgment or award against the customer; and (3.) reimbursing S & K Label Company, Inc. for any
legal fees and expenses it reasonably incurs in responding.
17. Electronic Manuscripts/Images
It is the client's responsibility to maintain a copy of the original computer files, artwork, and transparencies. S & K Label Company, Inc. is not responsible for accidental loss or damage to media supplied by the client or for errors on supplied artwork furnished by the client. Until S & K Label
Company, Inc. can evaluate digital input, no claims or promises are made about our ability to work with jobs submitted in digital format, and no liability is assumed for problems that may arise. Any additional translating, editing or recreations needed to utilize client-supplied files will be charged at our current
rates. S & K Label Company, Inc. does not archive your work for longer than it takes to produce the final product. Please save your work!
18. Claims
Claims for defects, damages, or shortages must be made by the client in writing no later than 30 calendar days after delivery. If no such claim is made, S & K Label Company, Inc. and the client will understand that the job has been accepted. By accepting the job, the client acknowledges that S&K Label Company, Inc.'s performance has fully satisfied all terms, conditions, and specifications.
19. Disputes & Venue
For legal purposes, the venue for any dispute shall be Bloomingdale, Illinois, USA
20. Right to Subcontract
S & K Label Company, Inc. shall have the right to assign any portion of the work required to another contractor.
21. Samples
S & K Label Company Inc. may use your product for samples or advertising purposes unless notified in writing of its inability to do so. In the event of a written notice, S & K Label Company, Inc. will cease its usage of your product within 30 days of receipt of the notice. Any usage of the product for samples or advertising purposes prior to the receipt of the written notice will be deemed as acceptable.
22. Design Specifications
All artwork submitted must meet the guidelines as set forth by S&K Label Company, Inc. Files which do
not meet these requirements will be rejected or corrected at S&K Label Company, Inc. discretion. Time spent on correcting or conforming improper artwork will be billed at the current rates. Please refer to
the Preparing Your Artwork section of this site for more information.
23. All Sales Are Final
Since each job is custom created for its owner, it can not be reused or resold to other clients.
24. Privacy Policy
Your privacy is very important to us. Your information will only be used to complete your order. Under
no circumstances will your information be sold or used for any other purpose. Occasionally, S&K Label Company, Inc. may send out special notices regarding new features and products. At your discretion,
you may also opt-in to receive special promotional emails which may include discounts and other special offers from S & K Label Company, Inc.
25. Changes
S & K Label Company, Inc. may change, modify, add or remove portions of this policy at any time, and
any changes will become effective immediately upon being posted unless stated otherwise. This policy
was last revised in October of 2019.
